Accident in a WalMart parking lot and the other party's insurance denied my claim... any advice?

Hi everyone, I would appreciate your ideas regarding the following situation: My son had a car accident last week in a nearby WalMart parking lot (Dallas, Paulding County, GA). He was driving down a parking lane and hit a car which came out of nowhere cutting across the aisle. Both vehicles had extensive damage (front of the vehicle on our car, and driver side on the other car). There was a gentleman who saw everything and called 911. The sheriff's deputy arrived at the scene promptly. He explained there would be an accident report, but since this happened in a private parking lot, he was not in a position to state who was at fault. I got the report the other day and it states the facts about the accident and gives the contact information for the witness. I have spoken with the other driver's insurance company three times and I just found out that their claims rep has determined that my son was at fault, so they have denied my claim. The claim with them was actually originally filed by the other driver. I politely asked to speak with a supervisor and was advised that I should expect to receive a call from a supervisor soon. I did not get a chance to talk to my insurance rep after I found out the other insurance denied the claim, but I am not sure if there is anything my insurance can do for us, especially given the fact that we only have liablity coverage on this vehicle (no collision coverage either). I think it is really outrageous how they could claim my son was at fault, if all evidence points to the fact that their insured was driving across the parking lanes and obviously did not see our car. I cannot find anything online (like traffic regulations) that explicitly says that the driver cutting across the parking lanes is at fault if there is a collision, but I think it is common sense that this should be the responsible party! If anyone has had a similar experience, or has any suggestions, your help will be very much appreciated!

I got 6 points back in 2009 for speeding with a drink drive ban the same night! I don't need any lectures. I can easily say biggest mistake of my life! I done my time and still paying for it. Since 1997 I've been with the same car insurance company. Have had FANTASTIC service and support with claims and general questions. I use the same company for car insurance, home owner's insurance, life insurance, and to manage my IRA. When pricing out alternatives I realize that I could save about $50 a month by switching my car insurance to esurance. I attempted to get my current insurance to match their price without success. I'm very leery about possibly loosing my excellent service and support from my current company. Would you switch to a new company, and possibly a worse company, to save money?? I can easily afford my current company, but I'd obviously love having an extra $50 a month to plan with.

Our new health care legislation is supposed to provide affordable health care and insurance for everyone. How exactly does that work? For example, I make about $37,000 a year. About $3200 of that goes to pay my insurance premiums. That's not really affordable, but, whatever. My job absolutely sucks. It's the worst one I've ever had. If I went to work at McDonald's or Wal-Mart, where would my affordable health care come from? Who decides how much I can afford to spend? No politician is going to be able to figure out how an ordinary American lives and what they can afford. I know this sounds like angry, bitter ranting, but it's a serious question. I was quoted 1200 the beginning of this month for car insurance (its due feb, but I regularly look at quotes). I then looked the 23rd and was quoted over 2000 for identical insurance (just by refreshing the quote). It has then increased drastically every day by around 1000 so its now looking at over 5000 a year to insure a 2007 FORD KA!!! I'm 17 and have 6 months no claims, plus the time I had no claims as a learner too (another 4 months). I understand that the equal insurance for men & women effects this and due to my age insurance is high, but two of my male friends insurance is shooting up too. I'm in a pretty good area, don't drive that much (3000 miles a year) and have both parents with 25+ years driving on my policy. How can my insurance possibly be increasing be so much? What can I do to bring it down, other then selling a car I need?
